General provisions
- This Privacy and Cookies Policy defines the rules for using, sharing and protecting your personal data (hereinafter: “Personal Data”) obtained through the following websites:

- This Privacy Policy is an integral part of the Packhelp Website Terms and Conditions (hereinafter referred to as the “T&C”). Definitions of terms used in this Privacy Policy are included in the T&C. The provisions of the T&C shall apply accordingly.
- The Controller of your personal data within the meaning of the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation), hereinafter the “GDPR”, is Packhelp S.A. based in Warsaw, ul. Kolejowa 5/7, 01-217 Warsaw, entered into the Register of Entrepreneurs kept by the District Court for the Capital City of Warsaw in Warsaw, 13th Commercial Division of the National Court Register (KRS) under KRS number: 0000831872 (hereinafter: “Controller” or “Packhelp”)

- Packhelp makes every effort to respect the privacy of Users visiting the Website and using Packhelp services. Packhelp guarantees the confidentiality of all personal data provided and ensures that it takes all the security and personal data protection measures required by the personal data protection regulations. Personal data are collected with due diligence and are properly protected against unauthorised access.
Information we collect
- We collect information about our Users and visitors to our Website.
- When you visit our Website, we automatically collect the following information about you: IP address, type of operating system, type of web browser, activities on the website: visit to a particular page and clicks on function buttons.
- If you give us your Personal Data by filling in a registration form to set up an Account or contact us, we collect the following Personal Data: e-mail address, first and last name.
- If you provide your Personal Data to us for the purpose of completing an Order, we collect the following Personal Data: e-mail address, first and last name, company name, country, NIP (or equivalent tax ID), address, postal code, town, voivodeship (or equivalent).
- If you contact our customer service employees, you can also provide to us your other Personal Data, depending on the subject of the inquiry addressed to the customer service department. During telephone contact, we will process your voice recorded during the conversation, about which you will be informed before the conversation starts.
- From time to time, Packhelp can offer you participation in lotteries, competitions and surveys on our Website. If you participate in them, we will collect other Personal Data, depending on the terms of lotteries, competitions and surveys. Participation in these lotteries, surveys and competitions is completely voluntary and therefore you have the option to choose whether you wish to disclose the requested information.
- The provision of Personal Data is voluntary, but the lack of consent to the processing of Personal Data marked as obligatory will prevent Packhelp from performing relevant services and Sales Agreements.
Purposes, scope and duration of personal data processing
- Purpose of processing: performance of the service agreement by Packhelp.
- Legal basis: Art. 6(1)(b) of the GDPR regarding the conclusion, performance and termination of the concluded agreement (data processing necessary for the performance of the agreement made with Packhelp).
- Storage period: the period necessary to perform, terminate or expire the contract.
- Scope of data: e-mail address, first and last name, company name, telephone number, position, tax identification number, address.
- Purpose of processing: contacting Packhelp, including answering your inquiries via chat
- Legal basis: Art. 6(1)(a) of the GDPR (consent to the processing of Personal Data).
- Storage period: until the User withdraws the consent and, after the withdrawal, for a period corresponding to the period of limitation of claims which may be raised by the Controller and which may be raised against the Controller.
- Scope of data: first and last name, e-mail address and other data voluntarily included in the message content.
- Purpose of processing: contacting Packhelp by telephone, including answering your inquires, improving Client service quality, assessing the quality of services provided by Packhelp, conducting trainings for employees and associates of Packhelp
- Legal basis: Art. 6(1)(a) of the GDPR (consent to the processing of Personal Data).
- Storage period: until the User withdraws the consent or within 6 months from the date of the data collection.
- Scope of data: voice recording, telephone number, first and last name, e-mail address and other data voluntarily provided during the conversation.
- Purpose of processing: fulfilment of tax obligations
- Legal basis: Art. 6(1)(c) of the GDPR in connection with Art. 86 § 1 of the Tax Ordinance Act of 29 January 1997 (i.e. JoL. of 2019, item 900) and/or Art. 74 par. 2 of the Accounting Act of 29 September 1994 (fulfilment of legal obligation).
- Storage period: the data are stored for the period required by the provisions of law ordering the Controller to keep tax books (until the tax liability limitation period expires, unless tax laws provide otherwise) or books of account (5 years from the beginning of the year following the financial year to which the data relate).
- Scope of data: First and last name, company name, tax ID (NIP) of the User, financial data related to the performance of the agreement.
- Purpose of processing: establishment, exercise or defence of legal claims which the Company may raise or which may be raised against the Company in connection with the order placed or agreement concluded
- Legal basis: Art. 6(1)(f) of the GDPR (pursuing legitimate interests of Packhelp related to the establishment, exercise or defence of legal claims).
- Storage period: the data are stored until the expiry of the limitation period for claims resulting from the agreement made with the Company, while the limitation period is specified by the Civil Code.
- Scope of data: e-mail address, first and last name, NIP (tax ID), PESEL (personal ID), financial data, telephone number.
- Purpose of processing: undertaking promotional and marketing activities, including sending marketing and commercial information to Packhelp customers in electronic form
- Legal basis: Art. 6(1)(f) of the GDPR (a legitimate legal interest of the Company, i.e. marketing activities aimed at its clients).
- Storage period: duration of the agreement made with the Company, not shorter than the period of having an active User account.
- Scope of data: first and last name, e-mail address and other data voluntarily included in the message content by the User
- Purpose of processing: sending a newsletter
- Legal basis: Art. 6(1)(a) of the GDPR (consent to the processing of Personal Data) and Art. 9(1)(f) of the GDPR (pursuing the legitimate interests of Packhelp related to the determination, investigation and defence of claims).
- Storage period: until the User withdraws the consent and, after the withdrawal, for a period corresponding to the period of limitation of claims which may be raised by the Controller and which may be raised against the Controller.
- Scope of data: first and last name, e-mail address and other data voluntarily included in the message content by the User.
- Purpose of processing: to maintain and improve our Website, including the security and personalization of your use of the Internet, ensuring that the content is presented to you in the most effective manner, as well as to administer our Website and to perform internal operations, including troubleshooting, data analysis, research, testing, statistical and research purposes.
- Legal basis: Art. 6(1)(f) of the GDPR, i.e. the legitimate interest of the Company, i.e. to improve the Website and provide services to visitors to the Website
- Storage period: 6 months
- Scope of data: first and last name, e-mail address, IP address, type of operating system, type of web browser, activities on the website: visit to a particular page, clicking on functional buttons.
- Purpose of processing: providing or allowing us to provide you with information about Goods and services that we think may be of interest to you
- Legal basis: Art. 6(1)(a) of the GDPR (consent to the processing of Personal Data) and Art. 9(1)(f) of the GDPR (pursuing the legitimate interests of Packhelp related to the determination, investigation and defence of claims).
- Storage period: until the consent is revoked by the User, and after the consent is revoked, for a period of time corresponding to the period of limitation of claims that may be raised by the Administrator and which may be raised against him
- Scope of data: first and last name, e-mail address, IP address, type of operating system, type of web browser, activities on the website: visit to a particular page, clicking on functional buttons.
Providing personal data is voluntary, but necessary to perform the agreement and use the services provided by Packhelp, receive a newsletter and marketing information. If the basis for the processing of personal data is your consent, you can withdraw it at any time by contacting us via e-mail sent to the following address: [email protected]. Withdrawal of consent to data processing does not affect the correctness of personal data processing until its withdrawal.
Personal Data Recipients
For the proper operation of the Website and professional provision of services, Packhelp must use the services of external entities. Packhelp only uses the services of processors who provide sufficient guarantees for the implementation of appropriate technical and organisational measures so that the processing meets the requirements of the Regulation and protects the rights of data subjects.
- We may entrust your Personal Data to third parties for processing. Then, the recipients of your Personal Data are:
- in the case of operations specified in the T&C: we may transfer your Personal Data to entities supporting us in our current activities, including entities performing components of Orders or other Packhelp services indicated in the T&C or making it possible for Packhelp to perform such operations. This may be in particular:
- providers of accounting, financial, legal and advisory services,
- provider of hosting services for the Website,
- company providing technical services for the Website,
- payment company,
- carrier
- company providing software used to perform the operations specified in the T&C, including service providers supplying the Company with technical, IT and organisational solutions,
- other entities if the use of their services is necessary for the proper operation of the Website and the provision of services by the Controller,
- in the case of External Partners: we may work with third parties to provide you with access to information about Goods or Services that we think may be of interest to you. We will disclose your Personal Data to third parties only if you have agreed to receive information from third parties,
- in the case of a merger, sale or acquisition: in addition, it is possible that another company will acquire Packhelp or its assets, or that Packhelp will become a partner or will purchase another company for the purpose of continuing its business as a combined entity. If such a transaction takes place, our information about the Users, including Personal Data, may be transferred to a new business entity as one of Packhelp’s assets. In such a situation, we will update this Policy to reflect any changes to the ownership or control of Personal Data.
- in the case of operations specified in the T&C: we may transfer your Personal Data to entities supporting us in our current activities, including entities performing components of Orders or other Packhelp services indicated in the T&C or making it possible for Packhelp to perform such operations. This may be in particular:
- Personal data collected by Packhelp may also be made available to: relevant state authorities at their request under relevant provisions of law or other individuals and entities – in cases provided for by law.
- Each entity entrusted with Personal Data processing by Packhelp guarantees an appropriate level of security and confidentiality of Personal Data processing. The Processor shall process Personal Data based on the Personal Data Processing Agreement.
- Personal Data may be disclosed to unauthorised entities under this Policy only upon your prior consent.
- Packhelp may transfer Personal Data to third countries if any of the entities referred to in subpara. 4.1.1. above processes data in a third country and only when the European Commission has established an adequate level of protection or through contractual clauses approved by the European Commission.
Profiling
As part of the Websites, profiling is done by recording sessions, analysis via "clickmaps" and analytics based on recording of events (Segment), consisting in creating dynamic and automated:
- advertising messages and content,
- forms of after-sales communication,
- methods for segmenting contacts and sending e-mail messages,
- reminders about an abandoned shopping cart,
- methods for selecting communication channels,
- methods for managing contacts.
The result of profiling will be the generation of personalised marketing activities and the creation of analyses and sales forecasts.

User’s rights
A Website User has the following rights resulting from the processing of their personal data:
- right to request access to their personal data – the User has the right to obtain confirmation whether the Controller processes their personal data and, if this is the case, the User has the right to access the data and receive information concerning data such as: purpose of processing, categories of data, information about recipients or categories of recipients to whom the data have been or will be disclosed, planned period of personal data storage or criteria for determining this period; the above right also includes the right to receive copies of data free of charge (for any subsequent copies requested by the User, the Controller may charge a reasonable fee resulting from administrative costs),
- the right to rectify personal data (when they are incorrect), which also includes requesting the completion of incomplete personal data,
- the right to erase personal data (the so-called “right to be forgotten”) in the following circumstances: when the User’s personal data are no longer necessary for the purposes for which they were collected, the User has withdrawn their consent to their processing and there is no other basis for data processing, the User objected to the processing, personal data have been unlawfully processed, personal data have to be erased for compliance with a legal obligation in Union or Member State law to which the controller is subject, the personal data have been collected in relation to the offer of information society services,
- the right to restrict data processing when: the accuracy of the personal data is contested by the User (for a period enabling the controller to verify the accuracy of the personal data), the processing is unlawful and the User objects to the erasure of data, the Controller no longer needs the personal data for the purposes of the processing, but they are required by the User for the establishment, exercise or defence of legal claims, the User has objected to processing pending the verification whether the legitimate grounds of the Controller override those of the User.
- the right to object to processing when: the User does not want the Controller to process the data,
- the right to data portability, including the right to receive from the Controller the data which the User has provided to the Controller, in a structured, commonly used and machine-readable format, including the right to have the personal data transmitted directly from the Controller to another Controller (where technically feasible),
- the right to withdraw consent to data processing at any time (without affecting the lawfulness of processing based on consent before its withdrawal),
- the right to lodge a complaint with the President of the Personal Data Protection Office when the User thinks that the processing of personal data violates the provisions of the Regulation.

Packhelp uses cookies, i.e. small text information stored on the User’s end device (e.g. computer, tablet or smartphone), which can be read by the Packhelp ICT system.

Server logs
- Using the website involves sending queries to the server on which the website is stored. Each query sent to the server is saved in server logs.
- Logs include the User's IP address, server date and time, information about the User's web browser and operating system. Logs are saved and stored on the server.
- The data saved in server logs are not associated with specific individuals using the Website and are not used by the Controller to identify the User.
- These data are used only for server administration purposes. Server logs are only auxiliary material used for administering the website and their content is not disclosed to anyone other than persons authorised to administer the server.
Website and Personal Data security
- Packhelp uses all necessary technical measures specified in Art. 25, 30, 32-34, 35-39 of the GDPR ensuring increased protection and security of Personal Data processing.
- We maintain physical, electronic and procedural safeguards as necessary to protect your Personal Data against loss, misuse, disclosure and alteration. For example, we use the Transport Layer (TSL) security technology to encrypt payment information when you purchase products via our Website.
- If you set up an Account on the Website, you must select a password to protect the information on your Account. Your password strength depends on you: you should choose a unique password and keep it secure. You can change your password as often as you want by going to the My Account section on the Website. You are responsible for keeping your password secret. Please do not share your password with other people. Our login process is designed to protect your privacy. If you have a problem with logging in to our website, make sure you use your registered e-mail address and correct password.
